HOUSE ENTRY SAFETY
We require that upon entry to the home that your dog is safely put away in a kennel, backyard, or room. When the dog is introduced to the trainer, the dog must be on leash unless your trainer states otherwise. This is to ensure our trainer's safety, your safety, and your dog's safety.
Failure to comply can result in forfeit of the lesson at the trainer's discretion.
LEASH POLICY
We’re passionate about safety and want to uphold local leash laws.
All dogs need to be held firmly by a responsible adult. At no time would we like dogs to be off-leash or dragging their leash while we are entering the home, out in public or in an unfenced area.
This is for your dog's safety, our Trainers safety, and local dog leash law mandates. We want to give you the best service possible so we make sure safety and law accordance are top priority!

GROUP CLASSES
ON-TIME START
We strive to start and end our classes on time. Safety and a good experience is our goal. Please be on time for your scheduled class, since we start at a certain location and move during the class we don't want anyone to get lost or left behind.
REGISTRATION / PAYMENT
Full payment is required to confirm your registration. Registrations that are not paid for, forfeit their spot in the class.
Registrations are not transferable to another class or another dog.
Registrations are not refundable, unless class cancellation occurs. (The full 6 weeks of class, not individual classes. Individual classes that need to be canceled will be made up on a later date)
GROUP CLASS REQUIREMENTS
Unless otherwise indicated, class will meet for 50 minutes.
Dogs must be current on all vaccinations appropriate for the dog’s age. Dogs are highly suggested to also be on some form of flea prevention.
Appropriate gear on the human need to be worn. Please wear closed-toe shoes, no sandals or backless shoes, no slippers, dress shoes, pumps, heels, etc. Sneakers or Hiking shoes are an excellent choice. Your safety is our concern.
The dog should be wearing a flat, buckle collar, head halti or harness as appropriate. Please no retractable leads (due to risk of injury up to amputation of extremities) 4-6 ft standard flat leads only. If you have any questions, we are happy to help you select the right training gear.
Female dogs in heat may be allowed in certain classes at the discretion of the trainer (Please contact your trainer before class to confirm attendance approval). The dog will be required to wear sanitary pants during class.
Have plenty of your dog’s favorite soft treats cut into small pea-sized pieces. The dog should value the treats as the tastiest and most rewarding thing EVER!
Please allow time to toilet your dog before class so that you and your dog are ready to start. Please be prepared to clean up after your dog outdoors and indoors.
Please arrive for class and be prepared for an on-time start. Late arrivals can result in missing the class if you can't find us for the duration of the class.
Children 7 years old and up are welcome to attend training classes, however, all handlers must be 18 years or older and physically able to restrain the dog. Persons under the age of 18 are only permitted to hold the leash with an adult present and handling a secondary safety line.
MISSED CLASSES
Group classes are progressive in nature, but we do offer class drop-ins to those that have completed basic training requirements. There are no make-up lessons provided for classes that the registrant did not participate in. If there is room in another group class, a registrant may participate in that class at the discretion of the trainer. Morgan's Pawsitive Pup Training is happy to schedule a private lesson at the location of the missed class but doesn't offer make ups at this point in time. The owner is welcome to join the next round as a drop in for the missed class prior.
PRIVATE LESSONS, DAY TRAINING, & REMOTE PRIVATE LESSONS
ON-TIME START
Your trainer will do their very best to arrive on time. Please have any training gear ready for when your trainer arrives. Most lessons run approximately one hour, but may run longer or shorter depending on the lesson purpose. We do work with animals that can be unpredictable, and we may need to spend additional time with a client if an issue occurs. If the client scheduled before you needs extra attention or we run into unexpected traffic on our way to your location, please understand that we may run slightly behind in our schedule, however, this delay will not impact the length of your lesson. Please keep this in mind when scheduling your day.
SCHEDULING / PAYMENT
Full payment is mandatory 72 hours before scheduled lessons to save appointment time. If payment is not received on time or before then the lesson will automatically be canceled, and can be rescheduled at the soonest availability.
If lesson is scheduled less that 72 hours before, payment will be required by the end of the business day. If payment is not received by that time, the lesson with automatically be cancelled, and be rescheduled at the soonest availability.
We want to make sure that we have space for scheduling everyone.
CANCELLATIONS / RESCHEDULING
We require a minimum of 3 days notice if you wish to reschedule your lesson. Lessons cancelled with less than 3 days notice will be forfeit and you will need to purchase an additional lesson if you wish to reschedule.
We do understand life can be unpredictable and do apologize for any inconvenience.
NO SHOWS
This is defined as the client not being present for a lesson (or access given to the dog in the case of day training). If the client is 20min or more late for the lesson time (or to giving access to the dog for day training) this will also count as a now show lesson.
This is unless notice is given at least 1hr before lesson of the late arrival exceeding 20min the trainer may offer a 30min lesson in its place. This will count as the full lesson of that day, and not have to be a forfeited lesson.
REFUND POLICY
Morgan's Pawsitive Pup Training holds a no refund policy for all classes, programs, no shows, Introductory lessons, canceling lessons less than 3 days before scheduled time, or lesson(s) that have expired their 3-6 month life span.
All services have a life span of 3 or 6 months. We do this to optimize the training plans by not having training too spread out.
4 Lessons - 3 months
5 Lessons or more - 6 months
Exceptions may be applied for approved circumstances to hold lesson credits longer than the 3-6 month life span. This will be approved on a case by case basis by the owner.
Morgan's Pawsitive Pup Training reserves the right to change the pricing structure on any and all curriculum without obligation to refund existing registrants of those classes.
VIDEO AND PHOTO RELEASE
Video or photos of classes, private lessons, and day training may be published on Morgan's Pawsitive Pup Training website. I hereby acknowledge that I, my dog, and my family may be included in classes, private lessons, or day training videos posted on Morgan's Pawsitive Pup Training website or future training videos. All video and photos are the property of Morgan's Pawsitive Pup Training.
Note: If participating in one of Morgan's Pawsitive Pup Training group classes the release of videos and photos is required to attend.
TERMINATION
Morgan's Pawsitive Pup Training reserves the right to terminate the training contract at any time before or during its term if the Trainer determines that a danger exists to the health and safety of the public, Trainer, owner or dog. Should the trainer terminate the program due to a violation of safety the trainer may terminate the contract upon company approval. In this case no refunds will be given.
Should the Owner terminate the training contract at any time prior to completion:

All fees for services are non-refundable
The use of or being under the influence of illegal drugs and/or alcohol before or during any class or private lessons will result in a cancelled contract with no refunds.
Contracts for on-going training are automatically terminated if we do not hear from the client within the services life span of 3-6 months scheduling period. After 3-6 months, on-going training contract will cease. No refund will be issued for any lessons or classes remaining
RELEASE OF LIABILITY
I do hereby waive and release, Morgan's Pawsitive Pup Training, from any and all liabilities of any nature. I agree to take complete responsibility for the action of my dog, and myself, and family members, before, after, and during class. At no time will the instructor be liable or responsible for the actions of myself, my dog or any other person who accompanies me to class.
I understand that attendance and participation in any training program is not without risk to myself and/or guests who may attend. I further understand that my personal dog is also at risk, during training, or that I may bring home an illness due to working around other dogs.
I agree to allow Morgan's Pawsitive Pup Training to discuss history, protocols, family dynamics, and any pertinent information with their veterinarian, appropriate animal professionals, family members, etc. as applicable.
I agree to take full and total responsibility for my dog at all times. I hereby waive and release Morgan's Pawsitive Pup Training, the shelter, property or business the training is located at, all owners and other animals in attendance, and any of the above-mentioned employees, owners, and agents from any and all liability of any nature for injury or damage which I or my dog may suffer, including specifically, but not without limitation, any injury or damage resulting from the action of any dog, and I expressly assume the risk of any such damage or injury while attending the training session, class or seminar, while supervising or interacting with a dog while on the grounds or surrounding area thereto. In consideration of my attendance and participation in training classes, I waive the right from any and all claims or claims by any member of my family or any other person accompanying me during the course as a result of any action by any dog, including my own.

Pet Sitting Agreement
This Pet Sitting Contract (this "Contract") is made effective date of signing by and between the pet owner and Morgan's Pawsitive Pup Training, Houston, Texas. In this Contract, the party who is contracting to receive the services shall be referred to as "The Client", and the party who will be providing the services shall be referred to as "MPPT".
Whereas “The Client” wishes to engage Morgan's Pawsitive Pup Training and Morgan's Pawsitive Pup Training agrees to undertake the services under the terms and provisions defined in this Pet Sitting Contract as well as “The Client” ‘s Information sheet (Exhibit A), Pet Information sheet (Exhibit B) and the Veterinary Release Form (Exhibit C) which shall all become part of this Contract. Any reference to pets in this contract shall refer to those specified on the Pet Information sheet.
DESCRIPTION OF SERVICES.
DESCRIPTION OF SERVICES.
MPPT will provide the following services (collectively, the "Services"):
Pawsitive Pup Sitting: Two daily visits to the pet owner's home, usually 60-75 minutes each, to care for pets and the home during “The Client” ‘s absence.
OR
Overnight Pawsitive Pup Sitting: Visits to the pet owner's home, usually 12-14hrs each day (this including overnight stay) otherwise excluding the 8-10hrs working during the business work week of Tuesday-Saturday, to care for pets and the home during “The Client” 's absence.
Add ons:
Mid-day check in: Upon request a possible 15-30min visit can be added for a daily fee to check on the pets during the day.
Medication Administration: A daily fee for administration of any needed medication.
Included:
Provide walks, exercise, pets and love, and training practice from previous training packages within given times.
PAYMENT FOR SERVICES. Morgan's Pawsitive Pup Training shall be paid the amount of:
Pawsitive Pup Sitting: $85.00 per day (unless over 7 days have been booked then the pricing goes to $75 per day) with a nonrefundable $50 deposit fee to save pet sitting dates. No deductions shall be made for late departure or early return of “The Client” with less than 7-day notice before scheduled pet sitting start date.
OR
Overnight Pawsitive Pup Sitting: $105.00 per day (unless over 7 days have been booked then the pricing goes to $95 per day) with a nonrefundable $50 deposit fee to save pet sitting dates. No deductions shall be made for late departure or early return of “The Client” with less than 7-day notice before scheduled pet sitting start date.
Add ons:
Mid-day Drop in: extra $25 each day requested by "The Client"
Medication administration: extra $10 a day of scheduled pet sitting
Deposit to save pet sitting dates will be due upon receiving invoice. Failure to pay $50 deposit within that time will result in the dates not being saved, this can lead to those dates no longer being available.
Total payment will be due 7 days before scheduled pet sitting (unless scheduled less than 7 days before start date, then it will be due upon receiving invoice). Miss of payment will result in cancelation of scheduled pet sitting dates until payment has been made in full. This can lead to those dates no longer being available.
Additional fees may include the purchase of necessary items for the care of the pet, including but not limited to pet food, litter or cleaning supplies, transportation, unexpected visits and emergency expenses for health care. Morgan's Pawsitive Pup Training shall retain and submit receipts as proof of additional expenses.
Payment of all additional fees or expenses effected will be due within 30 days of given invoice of the additional supplies obtained by “MPPT”.
EMERGENCIES. In the event of an emergency, Morgan's Pawsitive Pup Training shall contact “The Client” at the numbers provided to confirm “The Client” 's choice of action. If “The Client” cannot be reached in a timely manner, Morgan's Pawsitive Pup Training is authorized to:
a. Transport the pet(s) to the listed veterinarian on the attached Veterinary Release Form;
b. Request on-site treatment from a veterinarian;
c. Transport the pet(s) to an emergency clinic if the previous two options are not feasible.
RELATIONSHIP OF PARTIES. It is understood by the parties that “MPPT” is an independent contractor with respect to “The Client”, and not an employee of “The Client”. “The Client” will not provide fringe benefits, including health insurance benefits, paid vacation, or any other employee benefit, for the benefit of MPPT.
SECURITY. “MPPT” warrants to keep safe and confidential all keys, remote control entry devices, access codes and personal information of “The Client” and to return same to “The Client” at the end of the scheduled pet sittings or immediately upon request of “The Client”.
INJURIES. MPPT acknowledges MPPT's obligation to obtain appropriate insurance coverage for the benefit of MPPT (and MPPT's employees, if any). MPPT waives any rights to recovery from “The Client” for any injuries that MPPT (and/or MPPT's employees) may sustain while performing services under this Agreement and that are a result of the negligence of MPPT or MPPT's employees.
INDEMNIFICATION. The parties agree to indemnify and hold harmless each other as well as respective employees, successors and assigns from any and all claims, losses, expenses, fees including attorney fees, costs, and judgments that may be asserted due to acts or omissions of a party to this Contract.
LIABILITY. Morgan's Pawsitive Pup Training accepts no liability for any breach of security, or loss of, or damage to “The Client” 's property if any other person has access to the property during the term of scheduled pet sittings. Morgan's Pawsitive Pup Training shall not be liable for any mishap of whatsoever nature which may befall a pet or caused by a pet who has unsupervised access to the outdoors. Morgan's Pawsitive Pup Training shall not be liable for any pet stains/damage made by pet during scheduled pet sittings. Morgan's Pawsitive Pup Training is released from all liability related to transporting pet(s) to and from any veterinary clinic or kennel, the medical treatment of the pet(s) and the expense thereof. Morgan's Pawsitive Pup Training is released from all liability of injury to pet(s) caused by other pet(s) or animal(s) not under the control of Morgan's Pawsitive Pup Training.
ENTIRE AGREEMENT. This Contract contains the entire agreement of the parties, and there are no other promises or conditions in any other agreement whether oral or written.
SEVERABILITY. If any provision of this Contract shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Contract is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
APPLICABLE LAW. This Contract shall be governed by the laws of the State of Texas.

Membership Agreement
Morgan's Pawsitive Pup Training, hereinafter referred to as "Community", accessed via www.morganspawsitivepuptraining.com, and all current and future members of Morgan's Pawsitive Pup Training Membership Program hereinafter referred to as "Member".
By accessing, browsing or using the www.morganspawsitivepuptraining.com website or by selecting "I Accept" during the membership registration, you represent that you have read, understand and agree to be bound by the terms and conditions of this Membership Agreement hereinafter referred to as Agreement.
1. Nature of the Service
The Community provides to its members benefits such as but not exclusive to: 1-2 monthly private lesson or day training.
2. Governing Law
This Agreement shall be construed under and governed in accordance with the laws of the Texas.
3. Arbitration.
Any dispute arising under this contract shall be resolved under the commercial arbitration rules of the American Arbitration Association.
4. Services Details
This membership includes 1 (Pawsitive), or 2 (platinum) private lessons/day training monthly to the member for the length of the membership.
5. Length of Membership
The Member hereby agrees to the entirety of the length of the membership, and monthly charges for that length.
Until Canceled
6. Cancellations
Cancellations of membership are required to be given at least 30 Days in advance of the next scheduled payment. Cancellations given less than 30 days in advance of next payment will result in cancellation after to next payment.
A cancellation fee of $40 will be charged if Membership is ended before the life of the membership is up.
Any remaining lessons will be forfeit immediately after cancellation.
Individual lesson cancellations (same as other services) are excepted with a minimum of three days notice or the lesson is forfeit.
7. Scheduling
To ensure that you get a day and time that works within your schedule, request a booking or regular monthly lesson as soon as possible. Scheduling your day and time in advance will ensure that the desired slot is not filled by the time of requesting your lesson.
8. Credits
The life time of each credited monthly lesson will last the life time of the membership (excluding cancellation of membership or cancelation of lesson with less than three days notice). After the life time of the membership any remaining lessons will be forfeit.
Exception: If a renewal of membership is purchased within 3 Months after ending of previous membership (excluding cancelation of membership before lifespan of membership completed), any remaining lessons from previous membership will be rolled over to new membership.
9. Payments
Payments will be made on the day of sign up and reoccur every 30 days after. This payment will be automatically charged to the provided payment given at sign up.
Payment options will be limited to online options only. No in person payments (cash or check) will be accepted.

If you purchase MPPT's products and services, we collect billing and credit card information. This information is used to complete the purchase transaction.

However, you may be required to provide certain personal information to us when you elect to use certain products or services. MPPT may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. MPPT may keep track of the websites and pages our users visit within MPPT, in order to determine what MPPT services are the most popular.
